Il comandante: ultima barriera preventiva per la sicurezza del volo
Il comandante di aeromobile rappresenta, ancora oggi, l’ultima barriera preventiva per la sicurezza del volo. Questa la tesi esposta dal libro “Poteri e doveri del comandante di aeromobile” (Edizioni Mediterranee, pag. 240, euro 28) che l’autrice, Sarah Bruna, avvocato civilista e giuslavorista ed anche “quality auditor” presso gli operatori aerei, lei stessa figlia di un comandante di aeromobile ha presentato, con un intervento dell’avvocato Pierluigi Di Palma, presidente del Centro Studi Demetra, il 20 marzo a Roma, alla Casa dell’Aviatore. Nel libro Sarah Bruna provvede, tramite l’analisi razionale del contesto normativo, che individua attribuzioni di natura pubblicistica e privatistica in capo al comandante legate ad un’ampia discrezionalità decisionale sotto il profilo tecnico e operativo, unitamente alla raggiunta consapevolezza dell’importanza del suo inserimento nel processo organizzativo e produttivo dell’impresa aeronautica, a dare il giusto ridimensionamento alla sua figura. Questo senza però sminuirne affatto le funzioni, ma al contrario sottolineando il riconoscimento di una propria ed originale autonomia a livello giuridico. In tale contesto i poteri e i doveri del comandante risultano ben più ampi di quelli codificati perché si ricollegano a un concetto di partecipazione al momento produttivo connesso all’esercizio dell’aeromobile. Il Codice della navigazione ha lasciato pressoché immutate le disposizioni normative che riguardano il comandante, continuando a prevedere, ad esempio, all’art. 893, il dovere-potere del comandante di adottare i provvedimenti necessari per la salvezza dell’aeromobile, senza fornire in merito alcuna tipizzazione delle singole fattispecie. Il criterio guida dell’autrice è stato anche quello di rivalutare l’importanza del ruolo del comandante in termini di safety e security sia all’interno dell’organizzazione dell’esercente sua a livello più generale nell’interesse superiore della sicurezza della navigazione aerea.
