Infrazioni stradali: identificati e sanzionati anche all’estero
Il Parlamento europeo ha raggiunto l’accordo in merito alla proposta di direttiva della Commissione intesa a sanzionare le infrazioni al codice della strada commesse all’estero. Tra queste, in particolare, le infrazioni che sono causa del 75% delle vittime della strada: eccesso di velocità, mancato rispetto della segnaletica stradale, mancato utilizzo delle cinture o del casco di sicurezza, guida in stato di ebbrezza o sotto effetto di stupefacenti, nonché uso illegale della corsia di emergenza e del cellulare durante la guida.
La proposta prevede in particolare che un cittadino europeo possa essere identificato e sanzionato per l’infrazione commessa in uno Stato membro diverso da quello di immatricolazione del veicolo grazie ad una rete di scambio elettronico dei dati tra il paese di commissione del reato e quello di immatricolazione. Una volta individuati nome ed indirizzo del proprietario del veicolo, questi riceverà una lettera informativa predisposta secondo il modello previsto dalla proposta. Tuttavia, poiché quest’ultima non contempla norme di armonizzazione quanto alla natura dei reati e alle sanzioni da applicarsi, le infrazioni saranno perseguite in base alla legislazione nazionale dello Stato in cui l’infrazione è commessa.
La proposta passa ora al vaglio del Consiglio e, una volta approvata, entrerà in vigore conferendo agli Stati membri dell’UE due anni di tempo per provvedere al suo recepimento.
